医疗纠纷人民调解若干问题分析

Analysis on the Problems of the People's Mediation of Medical Disputes

尽管医患纠纷人民调解制度呈现出发展快速、覆盖面广、调处成功率高、社会反应好的特点,但通过文献分析,发现医疗纠纷人民调解制度仍存在一些问题,且对问题的研究过于集中和重复。对当前研究中未涉及的或观点不一致的问题进行了分析与论述,如受案范围问题、调解模式与透明性问题、调解目的异化问题、"诉调-调诉"对接机制的问题,以补充当前研究中的不足,并提出进一步缩小受案范围、创新调解机制、转变调解观念等建议,以期为医疗纠纷人民调解的发展提供参考与借鉴。

The characteristics of fast development,vast coverage,highly successful rate,and well reflection are reflected in people＇s mediation committee of medical disputes.According to literature review,it finds that the studies on the people＇s mediation of medical disputes are too centralized.Based on the practice and literature,this paper analyzes some problems which have not been discussed or have different view points,such as the problems of the accepted scope,the mediation model and transparency,the deviation of mediation aim.In order to complement the deficiency of the current studies and provide reference for the development of the people＇s mediation of medical disputes,some suggestions are put forward,such as narrow the accepted scope,innovate the mediation mechanism,transform the mediation conception and so on.
