摘要
WTO争端解决机制虽然以规则为导向,在一定程度上促进效率、体现公平,但是不同于新兴市场经济体和发达国家,最不发达国家由于自身实力限制,争端解决机制无法给予其直接的帮助,加上DSB裁决报告不具有优先效力,因此最不发达国家基本不通过争端解决机制处理争端。鉴于中国作为全球第二大经济体的国情,建议中国政府以积极态度参与WTO改革,更多地利用争端解决机制处理与新兴市场经济体、发达国家之间的贸易争端,并以国家利益为出发点建立协调机制执行DSB裁决报告。
WTO dispute settlement mechanism is rule- oriented, and to a certain extent,promotes efficiency and reflects fairness.However,due to their own condition,un-like the emerging market economies and developed countries, Least Developed Countries (LDC)fail to receive direct help from the dispute settlement mechanism.In addition,DSB ruling reports do not have the priority effect,and thus LDCs rarely use DSB to resolve dis-putes.As the world’s second largest economy,it is recommended that China should be pro-active to participate in WTO reform,further utilize the dispute settlement mechanism to re-solve disputes with other emerging market economies and developed countries,establish the coordination mechanism and implement the DSB ruling report on the basis of the national in-terests.
