我国职务作品著作权及其归属制度完善研究——以《著作权法》第三次修改为视角

On the Copyright of “Works Made for Hire”and the Upgrading of the System of the Ownership Thereof:From the Perspective of the Third Revision of Copyright Law of China

由于职务作品极具复杂性和特殊性,现行《著作权法》在对职务作品著作权归属制度的规定存在着诸多亟待解决的问题。国家版权局在面向全社会征求《著作权法》第三次修改意见的过程中,对该问题予以充分重视并进行了认真的研究。修改草案第一至三稿和送审稿都是在多方利益相关者的博弈中进行的。文章通过对职务作品基本理论的阐述,对职务作品与法人作品的对比区分、对国际上存在的职务作品立法模式的比较法考察以及对我国职务作品著作权及其归属制度立法现状的剖析,深入研究职务作品著作权及其归属制度,旨在针对修改草案对职务作品及其著作权归属制度的改革提出对策。

Because of the complexity and specificity of “works made for hire”, the current copyright law of China has many problems to be solved urgently with regard to the ownership of copyright.The National Copyright Administration has put lots of emphasis on this issue and repeatedly conducted researches and investigations, during t he process of soliciting ideas from the wohle soci tey when t hey conducted the third revision of the Copyright Law.The three draft amendments nad the draft for examination and approval are all conducted through contentions among the multi subjects.This thesis elaborates the basic theory about “works made for hire”, distinguishes them from corporate works, compares foreign legislative mode of them, and analyzes the current situation of Chinese ownership of the copyright thereof.It conducts deeply research on “works made for hire”, for the purpose of providing useful ideas for the reformation of the system thereof.
