摘要
演绎作品是一种特殊的著作权客体。我国现行《著作权法》对其著作权的归属以及行使规则规定较为简单,难以解决实践中出现的大量关于演绎作品的著作权纠纷,尤其是涉及在其他作品基础上制作的电影作品时,情况更为复杂。2011年7月,国家版权局启动了《著作权法》的第三次修改工作,在《著作权法》修订稿中,立法者引进了"演绎作品"这一法律术语,并细化了演绎作品著作权行使的一般规则,明确利用已有作品制作的视听作品是演绎作品,并规定其特殊的行使规则。相关修改仍值得进一步研究。
A derivative work is a special object of copyright.The common rule of the ownership and the enforcement of copyright of derivative works provided by the current copyright law of China is too simple to solve the problem rising from judicial practice.The condition becomes more complicated when the dispute involves the audiovisual works which are adapted from pre-existing works.In July 2011 , National Copyright Administration of China started the third revision of the Copyright Law of China.In the revised Draft, lawmakers introduced the derivative work as a legal term, specified the general rule to exercise copyright and special rule for audiovisual works adapted from pre-existing works, and related revision shall be still worth researching.
