基于整合立法视角的我国遗产资源保护专项立法构建

Establishment of Chinese Heritage Recourse Law from the View of Integration Legislation

自然和文化遗产的可持续开发与保护已成为世界各国共同的目标。遗产资源保护专项立法就是为了实现这一目标从法的高度构建的一套有效规则体系。鉴于我国遗产资源管理主体的多元化、多个部门法规交叉重叠的困境,文章借用西方整合立法的基本思路,指出我国遗产资源保护专项立法构建应从理顺管理体制和机制、构建制度性监督机制以及解决经营模式的选择等方面入手。

Sustainable development and protection of natural and cultural heritage has become a common goal of all countries. Special legislation to protect heritage resources in order to achieve this goal is to build an effective system and rules from the height of law. Given the diversity of heritage resource management body, multiple overlapping regulatory authorities dilemma, this article take advantage of the basic ideas of Western integration legislation, and point out that in order to build our heritage law our country should improve the management structure and mechanisms, build system supervision mechanisms and operations mode selection.
