摘要
"小产权房"流转问题凸显了经济学及制度上的各类矛盾,包括权利诉求增长与立法供给不足之间的矛盾、城乡利益平衡和制度成本偏高之间的矛盾、产权界定不明与契约选择自由之间的矛盾。本文试基于法经济学视角,从法律的需求与供给、法律的成本与效益、激励因素等各方面分析这些矛盾,形成制度经济学的分析框架,旨在解决矛盾,完善我国土地管理法、物权法等相关立法,为小产权房流转寻求出路。
The trading of limited property house highlights the various contradictions about economics and corresponding institution system,including the contradiction between the higher command of right claim and the lower supply of legislation,the conflict between the benefit balance within urban and rural areas and the huge cost of regime,the controversy between un-well-defined property right and the freedom of contract selection. This paper tries to study and analyze these contradictions,then comes to an analytical framework on the institutional economics about the regulation of limited property house. The opinion based on the perspective of economics of law,using the theory of demand and supply,cost and benefit,incentive and other determinant factor. The purpose is to solve the problem of limited property house,quiet down the conflict and contention about it,and reform the legislation,involving the land management law and property law.
