时运渐具、时机未成:《海洋基本法》热的冷思考

Re-thinking on the legislative enthusiasm of Ocean Basic Law

近年来制定《海洋基本法》的呼声渐隆。综合各方面情况而言,《海洋基本法》的立法内容尚未形成共识,改进现行海洋法体系并不必然需要《海洋基本法》,提高海洋法律意识及促进海洋法律研究与《海洋基本法》亦无直接关系,而且,制定《海洋基本法》并非世界海洋法发展潮流。因此,《海洋基本法》立法时机难言成熟。

In recent years,the calls for legislating Ocean Basic Law are increasing. Taking all cases into consideration,the legislative content of Ocean Basic Law has not reached a consensus,whereas the improvement of current legal system of law of the sea is not necessarily in need of Ocean Basic Law. Besides,neither raising legal consciousness in law of the sea nor fostering legal studies of it is in direct relationship to Ocean Basic Law. Moreover,it is not in conformity with the development tendency of international law of the sea to legislate Ocean Basic Law. Therefore,the legislative opportunity of Ocean Basic Law remains immature.
