咸丰朝巴县地区婚姻离异现象研究——以《清代四川巴县衙门咸丰朝档案选编》为中心

On Marriage and Divorce Phenomenon in the Ba County in Xianfeng Period of the Qing Dynasty——Taking File Collection of Sichuan Ba County Government Office in The Qing Dynasty as an Example

《清代四川巴县衙门咸丰朝档案选编》为我们提供了大量咸丰朝时期巴县地区的档案资料,从而为我们研究清代巴县地区基层组织生活提供了大量的原始材料。文章从清代四川巴县衙门咸丰朝档案中收集归纳有关婚姻离异的24个案例来探讨咸丰朝时期巴县地区的婚姻离异问题,主要论述婚姻离异的类型以及从这离异的案件中探讨地方县官在判案时与中央律法条规的不一致性,从中可以看出基层长官在判案时的灵活性,进而体现了与实际相统一的可操作性。

File Collection of Sichuan Ba County Government Office in The Qing Dynasty Supplied us with a lot of archives in Ba County of Xianfeng Period, which provided a large number of raw materials for us to study basic lifestyles of Ba County in the Qing Dynasty. This paper collected 24 cases about divorce in the Ba County from the Ba County Archives, and discussed the problems of divorce in these cases. It mainly discussed the divorced type and probed into the local magistrates who decided these cases inconsistent with the central law. As can be seen from these inconsistencies, the local chief executives had great flexibility in these cases, which reflected the operability uniting with the actual situation.
