On the Evaluation of Operation of Criminal Judicial Policy Combining Leniency With Rigidity

作为现阶段我国的一项基本刑事政策,宽严相济刑事政策对我国刑事法制的发展起着重要的导向作用。既有的研究成果,主要集中于对该政策内容的阐释或解析,偏重论理而忽视论证,对政策的贯彻情况和实施效果鲜有涉及;在研究方法上,注重定性分析,忽视定量研究,对政策的研究进路较为单一。本文主张将指标体系引入宽严刑事政策的研究之中,通过对政策可评估性、评估目标、评估方法等内容的分析,对刑事政策的评估问题展开研究,以期通过方法论的改进使刑事政策的研究更加深入。

As a basic criminal policy at the present stage in our country, the criminal judicial policy combining leniency with rigidity plays an important role in guiding the development of the criminal legal system of our country. The existing research results mainly focus on the interpretation or analysis of the content of the policy concentrating on the logic while ignoring the argument. The implementation of policy and its effects are rarely involved as in research methods. It focuses on qualitative analysis, ignoring the quantitative study, and the single approach of researching the policy is often adopted. The indicator system should be introduced into the study of the criminal judicial policy combining leniency with rigidity. The research on the evaluation of criminal policy should be launched through the analysis of assessability, evaluation target, and evaluation approach of the policy in order to enhance the study of the criminal policy by improving the methodology of the research.
