Ethical Efforts of Travelling Law and the Realization Way

《旅游法》甫一产生,就以旅游者权益保护为主线,并在权利义务对等原则下妥善处理了人和人、人和自然的关系。但百密一疏,《旅游法》在惠众和公平方面存在着不足之处。旅游业的精神价值远远超越其物质价值,《旅游法》应以"人的全面发展"为伦理目标。为此,国家应加大旅游管理体制改革的步伐,特别是导游管理体制改革和旅游资源管理体制改革。同时,必须转变观念,发展"社会旅游",保障弱势群体的旅游权利。此外,还需要其他制度配套前行,保障公民的旅游权利。

As soon as the production of Travelling Law, the protection of the rights and interests of tourists is taken as the main line, and the relations between human beings and between human and nature are solved under the principles equal rights and obligations. However, there are shortcomings in public benefit and fair in Travelling Law. The spiritual value of tourism industry goes far beyond its material value, which requires Travelling Law to take ＂all-round development＂ as the ethical goal. Therefore, our country should in- crease the pace of tourism management reform, especially the reform of tour management and tourism resources management system. Also, we must change our attitudes and develop ＂social tourism＂ to protect the rights of vulnerable tourists, in addition, we should perfect other related system and safeguard citizens＇traveling right.
