中国梦视域下的公权力刍议——以警察权为例

Discussion on the Public Power under the View of Chinese Dream——A Case Study of Police Power

中国梦的实现需要安定和谐的社会环境,维护广大人民的根本利益需要公权力的保障。警察权是公权力中的重要权属,对其界定、规约以及正常行使具有重要意义。论文探讨了中国梦与公权力之间的关系,明晰了作为公权力的警察权之内涵,并指出了其异化之成因。论文从法理视角对警察权进行了重新界定,并就如何规范警察权、构建行使公权力体制等提出了对策建议,从而有助于为执法领域的相关人员践行中国梦提供理论支撑。

The realization of Chinese Dream demands a stable and harmonious social environment, and the public power can guarantee the fundamental interests of Chinese people. The police power, as a kind of very important public power, needs to be defined, regulated and exercised normally. This paper discusses the relationship between the Chinese Dream and the public power, clarifies the connotation of the police power as well as the causes of its alienation. It also redefines the police power from the perspective of jurisprudence, provides suggestions on how to regulate the police power and construct the system of exercising public power, thus laying theoretical foundation for the law enforcement personnel in the process of realizing the Chinese Dream.
