农村土地承包经营权流转方式的困境与出路——以家庭承包土地承包经营权的流转方式为视角

Predicament and Outlet of Circulation Mode of Contracted Management Right of Rural Land——Based on Circulation Mode of Household Contracted Management Right of Rural Land

我国《物权法》以及《农村土地承包法》对家庭承包的农村土地承包经营权的流转方式做了较为严格的限制性规定,这种限制严重阻碍了农村土地承包经营权的顺利流转,不利于形成农业的规模化和产业化经营。因此,应根据党的十八届三中全会的精神,在法律层面上适时放开对家庭承包的农村土地承包经营权流转方式的严格限制,健全农村土地承包经营权流转法律制度,推动农村经济的健康发展。

Restrictions on the circulation mode of the household contracted management right of rural land in the Rural Land Contract Law of the People＇ s Republic of China and the Property Law of People＇ s Republic of China seriously hindered the smooth circulation of the contracted management right of rural land, which is not conducive to the formation of the scale and the industrialization of agriculture. So we should release limits to the circulation mode of the household contracted management right of rural land timely in the legal level according to the spirit of the Party＇ s Eighteen Plenary Session Three. We should also improve the legal system of the circulation of the household contracted management right of rural land, and promote the modernization of agriculture and the healthy development of the rural economy.
