摘要
日趋频繁、紧张的集体劳资争议充分暴露出我国倾斜性劳动立法的弊端。劳工权益无法真正得到保护的根源在于以"劳善、资恶"为理论基础的倾斜性劳工立法过分强调国家干预的重要性,严重忽略了"权利"的存在,重新陷入了"身份-契约-身份"的陷阱,导致劳资矛盾进一步激化。劳工权益保障的理想出路是转变倾斜性的保护思路,实行平等的法律保护机制,构建"个人契约-团体契约"的劳动关系理论,将劳资争议纳入到平等协商的轨道中来。
The increasingly frequent, intense group labor disputes fully expose the malpractice of China's tilted labor legislation. Labor rights cannot be truly protected for the fundamental reason that the tilted labor legislation based on "labor is good and capital is evil" overemphasizes the importance of national participation, but seriously neglects the existence of "rights", thereby falling into the trap of "identity-contract-identity" again and leading to further intensification of the labor-capital conflicts. The ideal way out for labor right protection is to change the thought of tilted protection, carry out the equal legal protection mechanism, and construct the labor-relation theory of "personal contract - group contract", thus outtin~ the labor-caoital disoutes on the track of equal negotiation.
