摘要
2013年10月25日,使用近20年的《消费者权益保护法》为适应当前经济和社会发展的需求被修改,其中引入了备受关注的第二十五条消费者"后悔权"制度。后悔权制度的形成过程和发展轨迹,逐渐显示出后悔权制度在运行过程中着存在大量问题。为了保障该制度的落实,应完善技术监管,赋予监管机构新职能;引入非现场消费仲裁前置程序;增加网络平台责任,实现以"网管网";进一步明确后悔权制度的实施细则。
On October 25, 2013, nearly 20 years after being put into effect, “Consumer Protection Law”was revised to meet the needs of the current economic and social development, including the introduction of Article 25 concerning consumers ’ right to regret. Focused on consumers’ right to regret, this paper reveals the formation and developmental path of consumers’ right to regret, so as to reveals the exiting problems and to protect the implementation of the system. Therefore, we should perfect techni-cal supervision, entitle new functions to regulators, introduce off-site pre-consumer arbitration procedures, increase network plat-form responsibilities and to implement rules for further clarification of the right to regret.
