Interpreting and Applying “the Responsibility to Protect”: Paths to Common Ground

摘要 "保护的责任"是在一系列的人道主义干涉引起多种争议下提出的,其中的一些条款被成功实施,但在肯尼亚、达尔富尔和苏丹等有关问题上,却引起了明显分歧,特别是在利比亚和叙利亚出现危机后,大国之间的僵持引发了关于对"保护的责任"的不同理解。对于"保护的责任",中国的立场是既不全盘接受也不一概否定;而美国尽管支持"保护的责任",但却继续持有自己的立场。如果"保护的责任"要成为一种行之有效的全球概念、规范或原则,就需要对其合法性、范畴、含义展开深入探讨,探索如何达成共识。 'The Responsibility to Protect'( R2P) was put forward against the background of contested humanitarian interventions. Some of its provisions have been applied successfully in some instances,but it has also provoked major disagreements on the issues about Kenya,Darfur,and Sudan. Especially after the crises in Libya and Syria,the current standoff among great powers has raised hard problems about its meaning and application. China now neither fully supports nor rejects R2P. Although America advocates R2P,it continues to take its own position. If R2P is going to be an effective global concept,norm or principle,it is necessary to consolidate a consensus about the legitimate rationale,scope,and meaning of R2P.
