环境法益与环境犯罪司法解释之应然立场

污染环境罪中"严重污染环境"之立法修正,使"环境"本身成为了犯罪的对象,标志着环境法益成为了中国环境刑法立法的基石。然而,2013年司法解释未能把握立法修正的核心变化,仍然混淆了环境法益与其他法益之关系,将解释立场定位于保护个人法益及社会管理秩序,缺乏对环境法益的独立诉求,造成解释内容在合目的性、合理性及合法性上产生诸多问题。据此,有必要在保护环境法益的基本理念指导下,针对污染行为的宽严尺度、主观罪过类型、既遂判断标准及刑罚处罚幅度等问题进行重新解释。
