摘要
目前,文化创意产业高速发展,而且成为产业转型升级的方向。但是,作为创意产业的核心——创意似乎被定义于二分法的"思想"的范畴而不予保护。本文从版权理论的体系结构、内容以及利益平衡三个角度对"创意"与"思想"进行区别分析,在此基础上将文化创意侵权定义为对文化创意作品实质内容的复制权的侵犯。明确文化创意的性质,将其作为"表现"的下位概念即实质内容,是时代以及产业发展的要求,将更好的保护创意者的智慧成果,也更加促进文化创意产业的进一步发展。
The cultural and creative industry has developed rapidly and directs the upgrade of industry transformation. However,as the core of the creative industry, creative seems to be defined as the dichotomy of the category of "ideas" that is unprotected.This articleanalyzed the difference between creativity and idea by clarifying the structure and the content of copyright, as well as the balance of interest, and defined the infringement of cultural creativity as the infringement in copy right of a cultural work's substantial content. To define cultural creativity as the subordinate concept of "expression", that is, the substantial content, is required by the industry development and the time. It would not only be better to protect the creators intellectual property, but also further promote the development of the cultural and creative industry.
