摘要 作为应对金融危机的经验总结,我国台湾地区出台了《金融消费者保护法》,并据此成立了金融消费评议中心,该中心主导的金融申诉专员机制以保护金融消费者为理念根基,拥有对各类金融机构的管辖权,并采用多种ADR技术手段处理金融消费争议。我国大陆金融纠纷多元化解决机制存在较多缺陷,可以考虑在借鉴该机制的基础上,分阶段创设符合我国大陆实践的金融申诉专员机制。 As the experience to the financial crisis, Taiwan introduced the Financial Consumer Protection Act, and established financial spending review center on the basis of this. The financial ombudsman service mechanism guided by this center took the financial consumers protection as the philosophy foundation, and it owned jurisdiction to every kind of financial institutions, got the solutions for financial consume disputes by many kinds of ADR technique means. There are a lot of shortages existing in the diversified resolution mechanism for our mainland financial disputes. We can consider that we should create the financial ombudsman service mechanism accord with national situations in stages on the basis of taking the Taiwan’s mechanism as a reference.
