返还原物请求权作为物权请求权的一种重要类型应否适用诉讼时效制度,学界看法并不统一,立法也未予以明确,司法实践中对同类型案件的处理结果也不尽一致,世界其他国家和地区的做法,对我国相关立法的完善提供了借鉴。

As an important type of claim right of real rights, whether the return of the original claims should applythe statute of limitations system, view of the legal circle is not unified, legislation has not made it clear, in the judi-cial practice on the cases of the same type of results is not consistent, the practice of different countries and regionsin the world would provide a good reference in the perfection of legislation of our country.
