摘要
大气污染的易流动性决定了大气污染防治是一个跨行政区域的多元主体联动协作的过程。我国政策中有一些关于跨行政区大气污染联合防治的措施,但国家立法中鲜有跨行政区大气污染联合防治规范,一些地方法规做出了有创见的规定。当前正值《大气污染防治法》修改之际,应藉此构建跨行政区大气污染联合防治机制,包括设立独立的跨行政区大气污染防治监督管理机构,建立系统的跨行政区大气污染防治制度,以此推动法规建立配套制度。
The characteristics of highly mobile determined that the prevention and treatment for air pollution must be complemented by joint action among diverse districts. Measures for trans - administrative air pollution prevention and treatment were presented in some national and local policies, whereas few rules treats trans - administrative air pollution prevention and treatment were presented in national laws. By contrast, some local reg- ulation made some original rules. Currently, revison of the law for air pollution prevention and treatment in China was on the agenda, trans - adminis- trative joint mechanism for air pollution prevention and treatment should be constructed in the amended version of the law, including constructing management organizations as well as comprehensive prevention and treatment regimes, so as to construct an relative system for trans - administrative joint mechanism.
