产业技术创新战略联盟视角下的专利池研究

A Research of Patent Pool from the Perspective of Industry Technology Innovation Strategic Alliance

当前,随着我国产业技术创新战略联盟建设工作的逐步深入,作为联盟建设最重要的组成部分的知识产权共享逐渐受到重视。专利池可以为联盟打造知识产权共享平台提供良好支撑,是联盟推动产学研合作的有利工具。在产业技术创新战略联盟视角下开展了专利池相关问题研究。首先,提出了联盟专利池的概念,梳理了其特点及作用;其次,提出了联盟专利池的建设流程;最后,对我国目前联盟专利池建设现状进行了分析,提出了加强我国联盟专利池建设的有关建议。

Nowadays, with the increasingly deepened construction of industry technology innovation strategic alliance in China, the sharing of intellectual property, which is the most important part of alliance constructions, has attracted considerable attention. Patent pools can support the alliance to create intellectual property sharing platforms, and has become an important tool to assist the cooperation of industry technology innovation. In this article, we will exam some aspects of patent pool from the perspective of industry technology innovation strategic alliance. First, we provide the concept of an alliance patent pool and discuss its characteristics and functions. Then we propose a typical construction process of an alliance patent pool. Finally, we analyze the current situation of alliance patent pools in China. Based on all the studies above, we put forward some suggestions on construction of alliance patent pools.
