Transfer of Patented Technology in China: Conditions, Problems and Solutions

对中国专利技术转移的状况和存在的问题进行分析和探讨。研究表明,经过20多年发展,中国已形成专利技术转移组织体系和法律保护及促进体系,专利转移呈现明显特征,但存在着多重管理、缺少协调机制,个别法律条文冲突,技术转移机构的定位及其主管部门不明确,业界不认同现行专利价值评估方法,政策激励力度不够,转移机构运行模式、从业人员结构不能满足需要等问题。针对存在的问题提出了相应的建议。

This paper analyzes the conditions, characteristics and problems of China＇s patent transfer in the past 20 years. The resuits show that China has formed the transfer system, legal system and promotion system of the patented technology transfer, the transfer system is characterized by four features. The study also indicates that there are problems such as multiple management, lack of coordination mechanism, several conflicts of laws, managing technology transfer organization without same rule, having doubt on patent value evaluation methods, weak incentives policy and others. Finally, the article puts forward the corresponding suggestions on the existing problems.
