论狄骥的公共服务理论与中国经济法的发展

On Duguit's Public Service Theory and the Development of China's Economic Law

公共服务理论首次被提出是在法国法学家莱昂·狄骥的著作《公法的变迁》一书中。该理论论述了主权理论的破产,公共服务的释义以及公法与公共服务的关系。虽然公共服务理论有一些不足之处,但是它通过对经济法中宏观调控法立法的启示和对经济法立法责任的界定这两方面指导了中国经济法的发展。

The public service theory was proposed the first time in The Change of Public Law written by a French jurist, Leon Duguit. The theory discusses the bankruptcy of sovereignty theory; the interpretation of public service and the relationship between the public law and the public service. Although the public service theory has some shortcomings, it guides the development of China＇s economic law through the inspiration of the legislation of macro-control law and the definition of the legislative responsibility of the economic law.
