浅析物流企业代收货款的法律性质及其规制——以临沂市为例

A Brief Analysis on the Legal Nature and Regulation in the Collection on Delivery of Logistics Enterprises

近年来,临沂经济得到快速发展,特别是临沂物流行业的发展,更是呈现百花齐放,百家争鸣的现象。但是也应看到繁荣的背后隐藏着一定的物流风险,例如物流企业的代收款。为了更加规范临沂物流行业的发展,体现临沂物流之都的美誉,文章以临沂为例,对物流企业代收货款的法律性质及其后果进行了分析,通过调查研究、文献、座谈会的方式,了解物流代收货款的性质,为物流企业管理提出一点建议。

With the high development of economy in Linyi, the logistics industry has been flourishing enormously in recent years. However, we should be conscious of the fact that inherent in this boom are the seeds of logistics risks. Some logistics enterprise collects payment for goods for another agency, for example. To promote normal development of the logistics industry, and to show that Linyi has been acclaimed as ＂the city of logistics＂, we take Linyi as an example and analyze the legal nature, and its consequences, of collection on delivery of logistics enterprises in this paper, through research approaches of literature survey, investigation and interview method. This article will forward a proposal on business administration of logistics enterprises, by gaining further insight into the nature of collection on delivery of logistics enterprises.
