Institutional Embeddedness and Technology Discipline:Effect and Limit of Real-name System as Network Governance

网络治理是一个世界性难题,而将实名制作为网络治理术至今却仍是一个备受争议的问题。目前学界对此问题的探讨,大都是基于对网络实名制概念的模糊认识而展开的利弊分析,遮蔽了其在不同网络层面和领域的实践适用性这一重要问题。通过"国家-市场-社会"三元互动结构的分析视角,我们可以发现,法律意义上的网络实名制,遵循着制度嵌入和技术规训的单向运行逻辑,有利于实现国家治理权力的网络渗透。但这种以国家为中心的治理模式,只适用于特定的网络层面和领域,如将其加以全面推行,则潜藏着诸多技术性和制度性风险,从而容易陷入内卷化的治理困境。增强网络实名制治理效能的关键,在于能否转变治理策略,在国家、市场和社会多中心的均衡治理格局之下推行"有限的网络实名制"。

Network governance is a worldwide problem. However,network real-name system is still a widely disputed problem. So far,most research work in the academic circles is on understanding about concept of the network real-name system,masking its applicability on different network strata and fields. From the analysis view of tri- dimensioned interaction about society- market- state,network real- name system of law meaning follows the unidirectional operating logic of institutional embeddedness and technology discipline,and it is beneficialfor state governance right to infiltrate network space. Obviously,the governance model is as country as the center,being just suitable for specific network strata and fields,not for everywhere. Otherwise,there exists great technical risk and institutional risk,and we will face involution management system. So we should change the management strategy to promote equilibrium governance of the state,market and society.This is the important way to raise the network management efficiency.
