多年以来,"自主知识产权"的概念一直被广泛关注和宣传,虽有不少争议,但并未打消和减弱人们对这个名词的使用和影响力,说明这个名词的提出和存在有一定的客观理由和基础,但也暴露出了一些认识上的问题。从"自主知识产权"概念提出和产生的原因出发,对人们使用"自主知识产权"概念时所暴露出的模糊认识,甚至认识上的误区进行分析探讨,提出对"自主知识产权"概念的再认识,指出知识产权是反映技术、市场、法律三者关系的概念,需正确认识核心技术与技术财产权的关系,以及建立立体专利保护网往往胜于一个有价值专利的独有。

The concept of ＇independent intellectual property＇ has been widely paid attention to andpropagated for many years, although there are many disputes on this term, the frequency of the use of it andits influence has never been weakened, which shows that there are some objective reasons and basises for theproposal and existence of this term, but also reveals some problems of our recognition. This article explainsthe cause of the formation and the proposal of the concept of ＇independent intellectual property＇, then analysesand explores the indistinct recognition and even misunderstanding revealed when the concept of ＇independentintellectual property＇ is used by public, and proposes a reconsideration of the concept of ＇independent intellectualproperty＇, indicates that the intellectual property is the concept reflecting a relationship among the technology,market and law, it is necessary to consider a relationship between the core technology and technology propertyright, and building a cubic patent protection net is often superior to possessing only one valuable patent.
