我国现代大学制度构建基础的缺失与重建

The Lack and Reconstruction of China's Modern University System Foundation

现代大学制度的基本特征是自治性与民主性,其存在基础是社会发展的民主化和法制化。当前我国现代大学制度的构建缺乏民主化和法制化的基础,构建过程中过于重视现代大学制度存在的"充分条件",忽视"必要条件"。重建我国现代大学制度的构建基础,就是重建有利于实现大学自由权、民主权的基础。应从完善法治建设和重塑法律对于大学及其利益相关者行为规范的权威入手,推进宪法和高等教育法等相关法律的进一步修订,将构建的重点转移到完善与现代大学制度有关的法律体系上来,通过明确的法律规范来限制和保护大学利益相关者的权力与权利。

The basic features of modern university system is autonomous and democratic. The system’s existence is based on democratization and legalization of social development. Lacking of the basis of democratization and legalization, China’s modern university system constructing currently emphasize too much on the“sufficient condition”and ignore the“necessary conditions”during the constructing process. Reconstruction of the modern university system foundation is equal to rebuild the foundation of the right of freedom and democracy. We should improve the law construction and remodel the authority,promote the amendments of the“Constitution”,“Higher Education Law”and other relevant laws,shift the focus to build and improve legal system of the modern university system,limit and protect the university stakeholder power through clear legal norms.
