论环境犯罪中的危险犯

The Potential Damage Offense of Environmental Crimes

危险犯是指把对法益的侵害危险作为处罚根据的犯罪。环境犯罪中的危险犯不要求出现特定的实质损害后果,只要造成某种危险状态就可成立。目前,环境犯罪存在危害潜伏期较长、阻碍经济发展、修复难等问题。解决之道应是借鉴国外有效经验,明确环境犯罪的客体,设立环境犯罪危险犯以及增设单位危险犯等。

Owing to the continuous development of industry and science technology, and the frequent incidents of environmental pollution, the ecological environment has been deteriorated. The former environment crimes are as follows ： first, potential damage offense which causes serious harm in the long run;second, environmental havoc which will hinder the development of economy ; third, the environment destruction which replays again after paying a heavy price. So we can draw lessons from foreign experience to make clear the object of environmental crime, to set up po- tential damage offense.
