论现阶段运行状态下警察权力的社会控制

On Social Control over Police Authority in Working at the Present Stage

警察作用的发挥必须通过警察权力的运行来实现。现阶段警察权力运行状态呈现出多样化的状态,即复杂的国际、国内治安形势下警察权力的强化和权力的不当行使衍生警察权力异化现象等。在此状态下考察权力运行特征及内在要求,必须对警察权力加以社会控制。从内容设置和程序设置控制的法律制度控制手段、组织控制手段和文化控制手段上,探讨警察权力超越不良运行状态、努力达成社会控制构想的实现。

The role of the police must be realized through exercising the police authority. At present stage, the exercise of the police authority is in diversified state. In the complicated international and domestic situation of public order, dissimilation of the police authority derives from the enforcement and abuse of the police authority. So in accordance with the characteristics and the inherent requirements of the authority exercise, the police authority must be socially controlled. We should discuss the undesirable operating state of police authority from the perspective of the means of legal control, organizational control and cultural control, achieve social control idea.
