对“较大的市”审批工作的思考

"较大的市"的审批标准应当是城市有无立法需求,是否具备立法能力。赋予城市立法权,需要合理评估城市的立法需求,综合考量地方事务的特殊性、地方立法权对于城市发展的紧迫性与必要性。城市的立法能力其实也是政府法制建设程度的体现。考察城市的立法能力可以侧重以下两个方面:发布规范性文件的工作机制、近几年所发布的规范性文件的质量。"较大的市"的审批标准不仅应当兼顾定性与定量评价,注重可操作性,而且要促进依法行政,切实监督"较大的市"的地方立法权。

The standard of the examination and approval of ＂major city＂ should be that whether the city has the need of legislationand whether it has the ability d legislation.To give the city legislative power,we need to rationally evaluate the legislative require-ments of the city,to comprehensively considerate the specific characteristics of local affairs and the urgency and necessity of locallegislative power for the city development.The legislative ability of a city is also a reflection of the construction level of the govern-ment legal system.To observe and study the legislative power of a city,we should lay particular emphasis on these two aspocts：theworking mechanism of formulating the regulatory documents ,and the quality of the regulatory documents formulated recent years.Thestandard of the examination and approval work of ＂major city＂ should not only give consideration to qualitative and quantitativeanalysis,and maneuverability,but also promote administration according to law,and conscientiously supervise the local legislativepower of ＂major city＂.
