论我国政府信息公开期限规定的完善

Improvementon the Regulation of Government Information Disclosure Deadlines in China

政府信息公开期限规定是信息公开程序的重要构成,完善信息公开期限规定有助于信息公开程序的规范化。我国现行的政府信息公开期限规定在告知形式、政府信息依申请公开网上处理追踪系统、第三方相关规定、延期规定的可操作性以及收到申请之日的规定等方面存在不足。基于对美、韩、日、英等国家有关政府信息公开期限规定进行分析,可从明确告知形式、构建政府信息依申请公开网上处理追踪系统、调整期限中止规定、完善延期答复期限规定等方面完善我国政府信息公开的期限规定。

Regulation of government information disclosure deadlines is an important component of government information disclosure procedures, and improving the regulations of information disclosure deadlines is beneficial to standardizing information disclosure procedures. There are some problems in current regulation of government information disclosure deadlines in China, such as the form of being informed, the online processing and tracking system of government information disclosure application, third-party regulations, the practicality of extension of the provisions and the regulations of the date of application received. Based on the analysis of United States, South Korea, Japan, Britain and other countries, we should explicitly tell people the form of being informed, build the online processing and tracking system of government information disclosure application, adjust the suspension period prescribed, perfect extension of the reply deadlines and other aspects to improve the regulation of government information disclosure deadlines in China.
