Network unfair competition behavior legal problem and its perfection

随着科学技术与经济的飞速发展,互联网产业增长迅速,相关网络行业竞争日益激烈,一些具有鲜明互联网特征的不正当竞争,不仅严重损害了经营者的合法权益,也严重破坏了网络经济的正常秩序。而我国现行《反不正当竞争法》对新型不正当竞争的规制存在许多不足,本文拟在我国修法之际提供一些有益的参考意见,以期促进网络市场的健康有序运行。

As the rapid development of scientific technology and the economy, the internet industry has witnessed tremendous growth, and the internet related industries have become more and more competitive. Some unfair competition with distinct internet characters has seriously damaged not only the legal rights of business owners but also the order of internet econom- ic. While the existing anti-unfair competition law can not cover every aspects of the new type of unfair compe- tition.This article aims at providing some useful sug- gestions during the amending of the current law which will be conducive to a health and orderly development of the internet market.
