涉众型经济犯罪群体性事件的刑法防控

Prevention and Control for Economic Group Crime Event in Criminal Law

在当前涉众型经济犯罪的发生越来越频繁,涉案范围、资金和人数急剧膨胀,社会危害性日益严重的情况下,涉众型经济犯罪群体性事件的若干基础性问题应被学界所重视。但基于理想主义和克制主义的思想误区,刑法学界却并不重视对其防控的研究。刑法应该本着务实的态度,从规范认定和政策适用的角度,合理防范及化解涉众经济犯罪群体性事件。

Due to the increasing occurrence of ec onomic group crimes, the range, the funding and number of people involved in cases are in rapid expansion, causing the serious social problems. So the fundamental questions must be noticed by the academics. But the prevention and control system basing on the misunderstanding of idealism and restraint have been ignored in criminal law research. This paper suggests that we must, from the perspective of norms and applicable policies, reasonably prevent and resolve the economic group crimes with pragmatic attitude.
