New Approaches to the Development of Chinese International Law

中国国际法发展的新思路包括理论与实践两方面。在理论方面,应遵循以下两条主线:一是将中国的和谐与西方的正义、公平、平等、善意等原则相结合,构建完善的自然国际法基本原则体系;二是将自然国际法与实在国际法结合,弥补以往割裂性移植西方法学理论的缺失。而在实践方面,应当建构适应于新世纪的实在国际法基本价值,促使实在国际法向符合自然国际法的方向发展。新的思路将即使中国国际法更好地融入主流国际社会,又使其具有独道特色;既有助于中国的和平发展,也有助于国际社会的和平发展。

The new approaches to the development of Chinese international law consist in two perspectives. Theoretically, one is to combine Chinese idea of harmony with western ideas of justice, equity, equality and bona tides in order to construct a perfect basic principle system of natural international law. The other is to link natural international law with positive international law in order to remedy the defects resulted from the separate transformation of western legal theories in the past. Practically, basic values of positive international law shall be constructed, which fits in well with the new century and promotes the positive international law to develop in the same direction of natural international law. Such new approaches will ensure Chinese international legal theories not only a better but also a distinguished place in the main stream of international society, and promote peace and development not only for China but also for the world.
