摘要
我国单位犯罪刑罚制度制定时间较短,制度设计上重刑主义色彩浓厚,背离了外部性的相互性原理,实践上存在着刑罚本身因素和刑罚超过因素导致的执行难现象,影响了刑罚目的的实现。基于学理性的分析和对外法的借鉴,建立单位犯罪刑罚准备金制度、强制性的内部干预处罚制度、区分性刑罚制度,是解决我国单位犯罪刑罚困境,实现刑罚善治之良策。
The time of establish punishment system of company is short.Inclination of punishment is clear.Departure from the principle of mutual externalities,implementation trouble is the origin of two fac-tor,one is penalty itself,the other is penalty exceeding.Base on the rational analysis and foreign law,es-tablish criminal penalties for the unit reserve system,internal interference penalty system,the distinction penal system.
