司法审判中的直觉运用——以“张辉、张高平”案为例

Intuition in the Judicial Trial and Correction of the Error——from the Perspective of “Zhang Hui and Zhang Gaopin” Case

司法裁判的过程,原本应该是一个理性的过程。但是,认知心理学告诉我们,直觉对人的思维有着十分重大的影响,自然也会影响着司法活动。法官在审理案件过程中,会不由自主地凭借内心的直觉,判断分析某一证据或事实的真伪。由于直觉存在主观性和臆断性,容易导致法官的审判出现偏差,这也是造成冤案的重要原因。因此,如何将直觉引入一个正确的轨道,避免法官在司法审判中出现主观臆断,是一个值得我们思考的问题。

The process of judicial decision should be a rational process. However, cognitive psychology tens us that intuition has great influence on human thinking, and naturally affects judicial activities. The judge in the trial process can not help analyzing and judging the authenticity of the evidence or facts by intuition. Due to the subjective and arbitrary nature of intuition, errors in the judgment are unavoidable, which are often the important cause of many injustices. Therefore, it is a question worth considering how to bring intuition into a proper orbit to avoid arbitrary decisions in the administration of justice.
