摘要
法治思维以信仰法律、尊重程序和保障权利为核心,对保障留守儿童的受教育权具有根本性意义。基于对原阳县留守儿童学校的观察,政府、学校、社会和家庭在留守儿童教育问题上各有短板又未能协调配合。亟需以公平正义思维保障受教育权的方向,以权利义务思维明确各方职责,在执法中强调程序和效率、重视责任追究和权利救济。应建立留守儿童受教育权的宣告机制、侵害预防机制、救济机制和国家帮助机制,从实践层面保证法治思维的落实。
The legal thinking take the belief of law , respect to program and rights protection as the core elements,It has fundamental significance to guarantee the education right of the left behind children. Basedon the observation of Yuanyang left-behind children school,we found that government, school, society and family all had shortcomings and poor coordination facing the left-behind children' s education problem.To solve the problem,it' s essential to adopt the legal thinking and use the rule of law.
