Analysis on Exclusion Rule of Illegal Evidence

为了排除我国不合法取证现象,惩罚犯罪,保障当事人的基本权利不受侵犯,应建立符合国情的非法证据排除规则体系,完善案件取证规则,建立非法证据排除规则的配套机制,完善非法证据排除规则,使取证工作向实体正义与程序正义并重的方向发展。文章在分析国内外非法证据排除规则学说的基础上,结合我国实际情况,提出相应的完善措施。

In order to curb the illegal collection of evidence ,punish crimes ,and protect the fundamental rights of the parties from being infringed ,we should establish a system of exclusion rule of illegal evidence in line with national conditions in China ,improve case evidentiary rules ,set up supporting mechanism of exclusionary rule ,perfect exclu-sion rule of illegal evidence ,and make evidence collection work develop in the direction of substantive justice and procedure justice .On the basis of analyzing domestic and foreign theories on exclusion rule of illegal evidence ,the author provides relevant improvement measures through combining it with China ’ s actual situation .
