我国集体土地权利研究——以权利平等保护为视角

The Study of Collectively-owned Land——From the Perspective of the Equal Rights Protection

国有土地与集体土地的二元制度格局造成了集体土地权利与国有土地权利上的巨大差异。按照物权法的权利平等保护原则,两者应处于平等的地位。而保障集体土地与国有土地享有平等的权利本身也是保护公民财产权利的客观现实需要。我国土地制度的未来改革方向主要从保护农民的土地财产权益着手,重点就是对现行集体土地制度进行改造,赋予集体土地更多的权利,保障集体土体与国有土地权利上的平等,赋予集体土地建设用地使用的权利,完善集体土地的权利体系,保障集体土地所有者的土地财产利益。

The pattern of binary systems of state-owned land and collective land results in great differences between the fights of collective land and state-owned land. The fights of property law advocate that the principle of equal protection of property fights is to protect the objective needs of citizens. Both should be in equal status in accordance with the principle of equal protection of property law. Safeguarding the equality of the collective land and state-owned land is the objective need of protection of citizens＇ property fights. Future land reform in China should be primarily to protect farmers＇ land property fights and to transform the system of collective land, to offer collective land more rights, to protect the equal status between them and to protect the vital interests of land owners.
