我国海上人命医疗救助制度的构建

海上医疗救助制度在我国现有法律法规中并未做出明确规定,法律法规仅仅规定了海上人命救助。两者之间界限不明确,在实践中存在诸多的问题。因此使得建立海上医疗救助制度成为一项非常具有研究价值和实践意义的课题。文中通过分析海上医疗救助与海上人命救助的区别,指出建立海上医疗救助制度的意义,并对建立此制度的途径进行了有益的探讨。

Currently, laws in China only cover those regulations that account for maritime rescue of human life, while legislation for maritime medical care is still in the state of vacancy. The blurred boundaries of two legal concepts lead to considerable issues in practice, which also makes construction of maritime medical care system a subject that entails great research value and practical significance. Via comparing the difference between maritime rescue of human life and maritime medical care, this paper indicates the importance and some necessary approaches to the construction of the system.
