摘要
将法官情感驱逐定罪过程是刑法学界的主流观点,理性的"神话"、情感的"被放逐"以及"被机械化"了的三段论推理是主要原因。实际上,无论是在解释论上,还是在思维方法论上,法官的情感因素都在整个定罪过程中悄然发生作用。情感与理性的融合、价值与逻辑的并重才是法官在定罪过程中应有的选择。
It is the mainstream to expel the judge＇ s emotion from the process of the conviction and sentencing in criminal law scholars. The main reasons are the ＂myth＂ of reason, the ＂exiled＂ emotion and mechanized syllogism. In fact, the judge＇ s emotion plays an important role in the whole process of the conviction whether in the theory of interpretation or in methodology. It is the right choice for judges to combine the emotion and emotion and reason, to emphasize value and logic.
