改革中国出入境管理体制刍议

Discussions on Reform of China Entry and Exit Administration System

结合新出台的《中华人民共和国出境入境管理法》,分析我国出入境管理体制的现状,探析我国新出入境管理法产生的变革。我国出入境体制存在中央事权名不副实、部门重叠管理混乱、边防检查宽入严出等弊端和问题,需从实现出入境管理的中央事权、改革现行的出入境管理机构、制定全国统一的移民法进行改革。

Combining the newly developed Exit ＆ Entry Administration Law of P.R. China, the article analyzes the status quo of China entry and exit administration system and explores the changes of the newly developed Exit ＆ Entry Administration Law. There are many problems and malpractices arising out of entry and exit administration system such as central government responsibilities, which are more in name than in reality, overlapping and disorderly management, easy entry and difficult exit in border inspection station. Therefore, efforts need to be made to develop unified national immigration laws for reform of the existing entry and exit administration organizations.
