摘要
我国当前的矿业权配置的总体特征为:三类矿产通过两种矿业权,在两级市场上,采用两类不同的流转方式进行配置。由于三类主体的目标不一,使两类流转在两级市场上存在配置"分歧",由于分类管理依据的矿种范围模糊,影响了两类矿业权调控矿产资源开发利用总量的效果。本文认为应该按照稳定、及时、经济和生态供给标准确定国家登记颁证矿种,使矿业权成为国家调控矿产资源开发利用总量的工具。
The general features of allocated with two kinds of minin mining right configuration of China are that three categories of mineral resources are g right transferring in the two different ways in the secondary market. The disparity management targets set for the three categories of resources results in the "divergence" of resource allocation in the transferring in the secondary market, and the ambiguity of mineral category definitions needed for the classified management does harm to the effects for the two kinds of rights to regulate the gross of resources exploitation and utilization. This paper argues that a stable, timely, economic, and ecological criterion should be followed to determine the mineral resources supply dimensions through the state registration and certificates, to make the mining rights be the tools for the state to control the gross of the resource development and utilization.
