我国社区矫正制度形态演化及体系特色

The Morphological Evolution and Characteristics of Our Community Correction System

随着我国社区矫正深入进行,"统一"、"专门"、"具体"的三种制度形态不断演化,呈现出非常复杂的互动作用关系;从系统、动态视角看,其体系特色为:多元多样多层的网络状态、双重或双面性的权力属性、开放发展的内涵方式;对于这种状况,应该辩证看待,并寻求从建立备案审查机制、促进多元的"造"法互动模式,促进内涵式公正发展三个方面化解有关矛盾,以推进我国社会矫正制度的发展。

With the deepening of Community Corrections, ＂unity＂, ＂special＂, ＂specific＂ of the three systems evolving forms, showing a very complex interaction relationship; from the system, a dynamic per- spective, the system features are.. Multiple diverse multi-network status, double-sided nature of the pow- ers or attributes, content development and opening up the way~ for this situation, should dialectical view, and seek review of the record from the establishment of mechanisms to promote pluralistic ＂create＂ law in- teractive mode, promoting connotation type equitable development of three aspects related to resolve con- flicts, to advance the development of our community correction system.
