农村生态保护中农民生态参与的困境、成因与对策

The Dilemma,Origin of System and the Legislative Countermeasures of Farmers Ecological Participation in Rural Ecological Conservation

当前农民生态参与在农村生态保护中并未发挥有效作用,存在着生态参与滞后、流于形式、无序化、缺乏积极性等问题。农民生态参与的困境主要源于知情权缺乏保障、生态参与程序规则缺位、农村非政府环保组织欠缺立法定位、生态公益诉讼渠道不通畅等制度性因素。为改善农村生态保护中农民生态参与的状况,需要健全农村环境信息公开制度,以专门立法建立生态参与的程序保障,赋予非政府环保组织法律地位,规定农民提起生态公益诉讼的资格和激励措施。

The current farmers ecological participation does not play an effective role in the rural ecological pro- tection, and there are ecological participation lag, formality, disorder, lack of enthusiasm etc.. The main source of farmers ecological participating dilemma is the right to know lack of security, the absence of ecological participation rules of procedure, lack of rural non government organizations of environmental protection leg- islation, ecological public welfare litigation channel is not smooth and other institutional factors. In order to im- prove farmers＇ ecological participation situation in rural ecological protection, we should improve the rural emri- ronmental information disclosure system, establish procedures to protect ecological participation in special legis- lation, given the legal status of non- govermnental environmental organizations, provide farmers bring ecologi- cal public welfare lawsuit qualification and incentive measures.
