摘要
恶意欠薪入罪正当性的争论没有否定刑法介入在处理极端事件中的突出作用,但刑法对恶意欠薪的规制作用是有限的,有必要对介入范围做出限定。杜绝恶意欠薪现象和对劳动者的薪酬权利给予及时有效的救济是两个层面的问题,刑法的介入只能在第一个层面上解决部分问题,不能因刑法的介入忽视对民事行政制度的完善。欠薪问题的整治是社会系统工程,需要多方面合力。
The debate of justification of malicious wages incrimination does not negate the prominent role of criminal law to intervene in dealing with extreme events, but the criminal law on the regulation made with malicious wages is limited. It is necessary to intervene to make a limited range. Putting an end to the phenomenon of malicious wages and effective remedies for salaries rights of workers are two levels of problems. Criminal involvement can only solve part of the problem on the first level, we should perfect the civil administrative systems in spite of the intervention of the criminal law. Wages remediation is a social system which needs more efforts.
