为了追求刑法解释的合理性,学界已提出了诸多颇有见地的观点和立场,但依然没有一个得到普遍认同且合理的标准或者原则。由于标准或者原则是抽象的,可能会沦为再解释的对象,故此为获得合理的刑法解释,一种方法或者工具比一个标准或者原则更为实用。博弈分析作为一种方法或者工具来追求最优的刑法解释应被提倡。对某个刑法规范作解释不一定追求完美,但应追求和谐。

Theories about criminal law interpretation have been put forward, but there is still not a reasonable standard or principle which is abstract. So in the field of the criminal law interpretation, the Gamemethod, as a positive method, is more practical than a standard or principle. As a method or a tool, game analysis should be advocated to seek the best criminal law interpretation. It＇s not necessarily to pursue perfect when interprete criminal rules, but pursuing harmony is necessary.
