我国国际私法学2011—2013年研究重点——兼析《中华人民共和国涉外民事关系法律适用法》

On the Research Priorities of China's International Private Law from 2011 to 2013

通过文献分析法和内容分析法对我国2011—2013年的国际私法学文献进行研究分析。在这一阶段,国际私法学者在涉外合同、涉外侵权、公共秩序保留、法律适用等传统领域仍有持续关注,而在涉外产品责任、涉外网络问题、涉外物权等领域扩展出新的研究内容。近3年研究重点还有一个最大特点,即以《中华人民共和国涉外民事关系法律适用法》相关条款为基点讨论国际私法各领域问题。分析结果表明,2011-2013年国际私法学的研究总体处于稳步向前的态势,紧跟国际私法学潮流趋势,特别于理论与司法实践相结合这一方面做得较以往成功。

Through documentary analysis and content analysis, the literature of International Private Law from 2011 to 2013 has been analyzed. In this stage, there is a continuing concern of private law scholar in the tradition areas of foreign contract, foreign infringement, reservation of public order and applicable law. Meanwhile, new contents for research have been extended in the international product liability, the foreign network problems, foreign property and so on. Nearly 3 years of research focuses on the relevant provision of Law of the People＇s Republic of China on the Laws Applicable to Foreign-related Civil Relations as the basis for the law discussion of International Private Law. Analysis results show that from 2011 to 2013, International Private Law research is in an overall steady trend, closely following the international private law trend, and especially does a better job in combining the theory and judicial practice.
