论我国《合同法》单一惩罚性违约金制度的设立

China's Contract Law Should Establish a Single Punitive Damages System

合同法实施十多年来,我国合同违约情况日趋严重,故意违约甚至恶意违约的行为随处可见。这与合同法中的规定的补偿性违约金制度有很大关系。在合同法中建立单一的惩罚性违约金制度,把补偿性违约金的功能交由违约损害赔偿制度解决,应当是诚信履约、提高守约率的一种重要制度选择,也是社会诚信体系建设的重大举措。本文仅就在合同法中摒弃补偿性违约金制度,建立单一的惩罚性违约金制度的相关问题谈点初步意见。

The implementation of China’s contract law more than a decade has witnessed serious breach of contracts,and ubiquitous deliberate default or even malicious default behavior,all of which has much to do with compensatory liquidated damages in contract law. The establishment of single punitive liquidated damages and the function of compensatory liquidated damages solved by compensation sys-tem should be the ideal selection,and a significant step for the construction of social credit system. This paper presents the viewpoints on the above mentioned problems.
