The Evolution of Historical Law:From a Genre to a Method

历史法学以历史主义法律观为核心,强调法的历史性因素,主张用历史去解读法律,用法律去阐明历史,以萨维尼为代表的德国历史法学不仅创立了比较系统的历史法学理论,形成了独立的历史法学术流派,而且开始使用历史考究的方法研究法律,之后以梅因为代表的英国历史法学在填补历史法学理论不足的同时,系统地使用历史方法研究古代法律制度,使历史法学成为系统的法学方法论体系,从此用历史的视角探究法律成为普遍的共识,用历史方法研究法律也成为法学研究的常规方法。

Historical law＇s core is a historical view of law, emphasizing the historical factors of law and advocating using history to interpret and clarify the history. German historical law which is repre- sented by Savigny not only created a theory of historical law relatively systematic and formed its inde- pendent historical law schools, but also started to study the law with historical exquisite method. British historical law which is represented by Maine used a historical method of systematic to research the ancient legal system and made the historical law become systematic methodology of jurisprudence, at the same time filling the theory of historical law, since then it was become a common consensus to explore the law using a historical perspective and a conventional method to use a historical method studying law.
